Living Fully

Plain-language summary (not a substitute for the full terms below). Living Fully is an AI tool for self-reflection and personal development — it is not therapy, not medical or mental-health treatment, and not a crisis service. It does not replace professional help. You are talking to an AI, not a person. You must be 16 or older to use it. We store your conversations securely and our staff does not read them except where the law requires it, where it's needed to keep someone safe, or where you ask us to. If you are in crisis, contact 988 (US Suicide & Crisis Lifeline) or 911.
These Terms of Service ("Terms") are a binding agreement between you and True Success For All ("TSFA," "we," "us," or "our"), governing your use of the Living Fully mobile application and any related services (together, the "Service"). By creating an account, tapping "I agree," or using the Service, you accept these Terms. If you do not agree, do not use the Service.
1. What Living Fully is — and what it is not
Living Fully is an artificial-intelligence developmental tool grounded in the True Success For All framework. It is designed to support reflection, self-awareness, and healthy personal development through conversation.
Living Fully is not, and does not provide:

Therapy, counseling, or psychotherapy. It is not a licensed mental-health professional and does not deliver mental-health treatment.

Medical, psychological, or professional advice, diagnosis, or treatment of any condition. Nothing it says should be relied on for medical, legal, financial, or other professional decisions.

A substitute for professional help. It does not replace a licensed therapist, physician, counselor, coach, or other qualified professional. If you need care, please seek a qualified human professional.

A crisis or emergency service. It is not monitored by humans in real time and cannot respond to emergencies.
You are interacting with an AI. Living Fully is a software program, not a human being, therapist, friend, coach, mentor, or authority figure. It has no lived experience, no professional judgment, and no duty of care. Its responses are generated by a language model and may be inaccurate, incomplete, or inappropriate. You are responsible for how you use its output. We disclose this plainly, and the app itself will remind you, in keeping with laws that require AI systems to identify themselves as AI.
No professional relationship is created. Using the Service does not create a therapist–patient, clinician–patient, coach–client, or any other professional or fiduciary relationship between you and TSFA.
2. Crisis and emergencies
Living Fully cannot help in an emergency. If you are thinking about harming yourself or someone else, or you are in a life-threatening situation:

Call or text 988 — the US Suicide & Crisis Lifeline (24/7, free, confidential), or chat at 988lifeline.org.

Call 911 or go to your nearest emergency room.

Outside the US, contact your local emergency number or a crisis line in your country (see findahelpline.com).
Do not rely on Living Fully to detect a crisis, alert anyone, or summon help. It does not do these things.
3. Eligibility and age
You must be at least 16 years old to use the Service. By using it, you represent that you are 16 or older and that you have the legal capacity to enter into these Terms. The Service is not directed to children under 16, and we do not knowingly collect information from them. If you are between 16 and the age of majority where you live, you should review these Terms with a parent or guardian.
4. Your account

Access. Living Fully uses passwordless sign-in: you enter your email address and we email you a one-time code. You are responsible for keeping access to your email account secure.

Accuracy. You agree to provide a valid email address that you control.

One person per account. Your account is for your personal, individual use. Don't share it or let others use it.

Eligibility of access. Access may be limited to certain users or email domains at our discretion; we may grant, restrict, or revoke access.
5. Acceptable use
You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms.

Rely on the Service as a source of medical, mental-health, legal, financial, or other professional advice.

Use the Service to harm yourself or others, or to encourage or plan harm.

Attempt to reverse-engineer, scrape, extract, or copy the underlying models, system prompts, reference material, or other intellectual property.

Probe, attack, overload, or interfere with the Service, its security, or its infrastructure, or attempt to gain unauthorized access to any account or data.

Upload or transmit unlawful, infringing, or malicious content, or impersonate any person.

Use the Service to build or train a competing product or model, or resell or commercially exploit the Service without our written permission.
We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful or unlawful.
Zero tolerance for objectionable content and abusive users. We have zero tolerance for objectionable, harmful, harassing, hateful, threatening, or otherwise abusive content or behavior. If an AI response ever strikes you as objectionable, you can report it from within the app — tap "Report," or press and hold, on any response — or contact us at the address in Section 16. We review reports and act on them, which may include removing content and suspending or permanently terminating the accounts of users who submit, solicit, or engage in objectionable or abusive behavior.
6. Your content

Ownership. As between you and us, the messages you write ("Your Content") are yours.

License to operate the Service. You grant us a limited license to store, process, transmit, and use Your Content solely to provide and maintain the Service — including sending it to our AI provider to generate responses, and as otherwise described in our Privacy Policy.

Improving the Service. We may use de-identified or aggregated data derived from usage to operate, secure, and improve the Service. We do not use the identifiable content of your conversations to train AI models. See the Privacy Policy for details.

Responsibility. You are responsible for Your Content and for not sharing information you don't want stored or processed as described in the Privacy Policy.
7. Our intellectual property
The Service — including the Living Fully app, the True Success For All framework and reference materials, the operator prompts, software, design, and branding — is owned by TSFA or its licensors and protected by intellectual- property laws. We grant you a personal, revocable, non-exclusive, non-transferable license to use the Service for your own personal development. No other rights are granted

8. AI output — no reliance, no warranty of accuracy
AI-generated responses are probabilistic and may be wrong. Living Fully can produce statements that are inaccurate, outdated, biased, or not suitable for your situation. It does not know you, your history, or your circumstances beyond what is in your conversation, and it cannot exercise professional judgment. Do not act on its output without applying your own judgment and, where appropriate, consulting a qualified professional.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, secure, error-free, or that its output will be accurate or reliable. We expressly disclaim any warranty that the Service provides therapeutic, medical, or professional benefit.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TSFA and its officers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service — including any reliance on AI-generated output — even if we have been advised of the possibility of such damages.
Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) US $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnification
You agree to indemnify and hold harmless TSFA and its personnel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
12. Changes to the Service and to these Terms
We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We may also update these Terms; if we make material changes, we will take reasonable steps to notify you (for example, in-app or by email) and update the "Last updated" date. Your continued use after changes take effect means you accept the revised Terms.
13. Termination
You may stop using the Service at any time and may request deletion of your account and data as described in the Privacy Policy. We may suspend or terminate your access at any time if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination (including Sections 6–11 and 14) will survive.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules.
Informal resolution first. Before filing any claim, you agree to contact us at the address in Section 16 and try to resolve the dispute informally for at least 30 days.
Binding arbitration. Except for the small-claims and opt-out carve-outs below, you and TSFA agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court, administered under the rules of a recognized arbitration provider, seated in Colorado.
Class-action waiver. YOU AND TSFA AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for intellectual-property or unauthorized-access claims in the state or federal courts located in Colorado, to whose jurisdiction you consent.
30-day opt-out. You may opt out of the arbitration and class-waiver provisions by emailing us at the address in Section 16 within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. If you opt out (or if these provisions are removed), the state and federal courts in Colorado will have exclusive jurisdiction over disputes.
15. Miscellaneous

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.

Severability. If any provision is found unenforceable, the rest remains in effect.

No waiver. Our failure to enforce a provision is not a waiver.

Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.

App stores (Apple / Google). You obtained Living Fully through the Apple App Store or Google Play. Apple and Google are not parties to these Terms and are not responsible for the Service or for support, warranties, or claims relating to it; that responsibility is ours, not theirs. You agree to comply with the applicable App Store or Google Play terms, and you confirm you are not located in a country subject to a US embargo or on a US restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
